Terms of service

Our business and these terms

Fraternal Light is based in Ventura, California. These terms govern purchases from fraternallight.com and use of our store. Delivery availability is described in our Shipping policy and the options for your item at checkout. Shopify provides our storefront platform.

Our Privacy policy, Return and refund policy, Shipping policy, and Contact information explain related practices and purchase terms. Read them before ordering. Nothing here removes consumer rights that applicable law does not allow us to waive.

Shopify processes visitor and purchase information, including for services based on interactions with other merchants and Shopify. Information is shared with Shopify and other third parties, including in other countries, for those services. Our Privacy policy and Shopify's Consumer Privacy Policy explain the processing and available choices.

You must be an adult legally able to enter a purchase agreement or have an authorized adult place the order. Provide accurate contact, payment, delivery, and personalization details, and keep account access information secure.

Products, prices, and order changes

We offer merchandise made and shipped through production and fulfillment partners. Production location, materials, available options, and timing depend on the product or agreed project.

Prices are in U.S. dollars. Applicable tax and shipping charges are disclosed before you pay. Product listings, prices, and availability can change for future orders. We do not increase the price of a paid order or materially substitute its product without your agreement.

We aim to describe products accurately. Screens and mockups may show colors or placement differently from the finished item, and natural materials can vary. Such differences do not excuse a defect, a material departure from the description, or incorrect production.

We may decline or cancel an order for a legitimate reason, such as suspected fraud, unavailable materials, an unresolved listing error, or a request that violates another person's rights. If we cannot fulfill a paid order as agreed, we will contact you to offer an agreed correction or alternative, or cancel and refund the affected portion, including applicable tax and shipping. We will not retain payment for merchandise we will not supply.

Personalization and proofs

Review sizes, colors, names, dates, spelling, and uploaded files before ordering. Simple text personalization is based on the details you submit through the website; a separate proof is not automatically included. A proof may be offered or required depending on complexity. We explain any agreed proof process and its effect on timing before you order. An approved proof records the design you accepted. Proof approval does not waive a remedy if we produce something different, deliver a defective item, or fail to meet another applicable obligation.

More involved custom work requires contacting us for a quote and agreed timeline before ordering. A separate accepted quote or custom-order agreement will address project-specific scope, materials, pricing, payment schedule, revisions, proof approval, production timing, cancellation, and any separately agreed artwork rights. Promotional permission, if requested, is a distinct optional choice. A general purchase does not grant it.

Cancellation and correction requests depend on production status as described in our Return and refund policy. Shipping delays and seller-caused nonfulfillment are handled under the Shipping policy and applicable law.

Customer files and permission to produce

You retain your ownership rights in the artwork, logos, photographs, and other materials you submit. You confirm that you own the necessary rights or have permission to use the materials and authorize their production for your order. We may ask for evidence of permission or decline work that appears unlawful or infringing.

You give Fraternal Light and the production providers working on your order limited permission to store, reproduce, format, and make necessary production adjustments to those materials for quoting, proofs, production, fulfillment, support, necessary recordkeeping, and future reorders while we retain the files for that purpose. Material design changes require your approval. This permission does not transfer ownership of your materials to us or grant promotional rights.

Private messages and customer files are not public submissions. We do not publish customer artwork or production files as standalone promotional material. We may showcase photographs of a finished custom product we made only under separate permission covering the agreed images and uses. The custom-project permission can address ongoing website display, social posts, other placements, and any individually agreed compensation. It does not automatically authorize every channel, future reuse, or disclosure of unrelated customer details. These general terms do not promise a payment for promotional permission. Our Privacy policy explains file retention, deletion requests, and other information handling.

Responsibility for rights in customer materials

To the extent permitted by law, you agree to reimburse Fraternal Light for reasonable losses and legal costs from a third-party infringement claim, but only to the extent caused by your breach of the confirmation above that you have the necessary rights or permissions for the materials you supplied. This does not cover losses caused by our or our production providers' unauthorized changes, use outside your instructions, negligence, or other wrongdoing. We will notify you promptly of a claim and give you a reasonable opportunity to participate in resolving it. We will not agree to a settlement at your expense without your written agreement. This clause requires reimbursement for covered losses; it does not require you to take over our legal defense or pay defense costs in advance. It does not limit any non-waivable consumer right.

Reviews, feedback, and store content

If you intentionally submit a review through a review feature we offer under these terms, you keep ownership of your review and give Fraternal Light nonexclusive permission to display and quote its text in our website content, social posts, emails, and advertisements promoting our products or store. We may shorten or format a review without changing its meaning. We may use the public display name you provide, but will not disclose your private contact information. We reserve the right to reject offensive display names. We may moderate unlawful content, spam, or disclosed private information, but will not prohibit honest criticism or remove a review solely because it is negative. This review permission does not grant promotional rights to customer artwork, production files, or photographs of custom work.

Suggestions sent privately may be considered to improve our business, but sending them does not give us permission to publish your identity, private message, or artwork. Any separate agreement about a commissioned design or other intellectual property continues to apply.

Our original store text, designs, and branding belong to us or the relevant rights holder. Buying a product does not grant a right to commercially reproduce those materials. This does not claim ownership of public-domain symbols or customer-owned artwork.

Acceptable use and external services

Do not use the store for fraud, unlawful activity, infringement, harassment, malicious code, unauthorized access, or collection of other people's private information. We may restrict misuse, but doing so does not remove our obligations concerning paid orders or required refunds.

External websites and optional external tools have their own terms. If you independently buy from an external website, contact that seller about its transaction. For anything purchased from Fraternal Light, contact us, including when a production or fulfillment partner makes or ships the item.

Security, warranties, and responsibility

Our storefront and checkout are provided through Shopify. Do not send payment-card numbers by email or a contact form. We use reasonable safeguards, but cannot guarantee that any website or communication method will always be available or completely secure.

We do not guarantee uninterrupted website access. Any disclaimer about website availability does not apply as a blanket disclaimer of the quality of physical merchandise or our obligation to fulfill accepted orders. Product descriptions, expressly offered warranties, and applicable statutory warranties and remedies remain in effect.

To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising solely from website interruptions. This limitation does not exclude liability for fraud, willful misconduct, gross negligence, personal injury, defective products, or any liability or remedy that cannot lawfully be limited. We do not cap a customer's right to a required refund or other required remedy.

Applicable law and updates

California law and applicable federal law govern these terms, subject to mandatory consumer protections that apply where you live. These terms do not require arbitration or waive a right to use a court otherwise available to you.

If a provision is unenforceable, the remaining provisions continue to apply to the extent allowed by law. These terms and the applicable product description, approved proof, and written order agreement form the terms for your purchase. A specific written agreement we both accept may supplement them, but cannot remove non-waivable rights. The Privacy policy governs information handling; it is not a substitute for any legally required consent.

We may update these terms for future use and orders by posting a revised Last updated date. Changes do not retroactively alter a paid order or expand our rights over previously submitted customer files without an appropriate agreement and any required consent.
